Da Vinci author in court

"The Da Vinci Code" author Dan Brown denied claims yesterday that he lifted material for his best seller from another book.

During a hearing yesterday in Manhattan Federal Court, Brown' s lawyer urged Judge George Daniels to toss out copyright infringement claims made by rival author Lewis Perdue.

Perdue claims Brown lifted plot material from two of his books - "The Da Vinci Legacy" and the "Daughter of God" and used it in "The Da Vinci Code . ".

Brown said the plagiarism claims are nonsense.

"We anticipate that the action shall be summarily dismissed," said Elizabeth McNamara, the lawyer for Brown and his publisher Random House.

But Perdue insists there are too many similarities between the whodunnits to be a coincidence.

In both "The Da Vinci Legacy" and "The Da Vinci Code" Da Vinci scholars are killed, the protagonists battle with secret evil societies over the fate of Christianity and the artist's work is mentioned in the plots.

....... Daniels will issue a ruling this spring.
